1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Bionic Forms ("we", "us", or "our") governing your access to and use of bionicforms.com and all related services (collectively, the "Service").

By creating an account, clicking "Get Started", or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Bionic Forms is a multi-tenant SaaS platform that lets teams build forms, collect responses, and analyze feedback using AI. Key features include:

• Drag-and-drop form builder and template library
• Response collection via public form links or embedded forms
• AI-powered response analysis (summaries, sentiment, themes, urgency)
• Team workspace management with role-based access
• Integrations with Google Sheets and other third-party services

We may modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password, or by signing in via a supported OAuth provider (Google or Facebook). You agree to:

• Provide accurate and complete registration information
• Keep your password confidential and not share account access
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account. Accounts registered on behalf of an organization represent that you have authority to bind that organization to these Terms.

4. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to collect data in violation of applicable laws (including GDPR, CCPA, or CAN-SPAM)
• Create forms designed to deceive, defraud, or mislead respondents
• Collect sensitive personal data (health records, financial account numbers, government IDs) without appropriate legal basis and explicit disclosure
• Send spam or unsolicited communications using data gathered through the Service
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware, viruses, or other malicious code
• Resell or sublicense access to the Service without our written permission
• Use AI features for high-stakes automated decisions affecting individuals (medical diagnosis, legal determinations, credit decisions) without human review

We reserve the right to suspend or terminate accounts that violate this policy at our sole discretion.

5. Subscription & Billing

Plans. Bionic Forms offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) via Stripe. Plan details, including response limits and feature availability, are described on our pricing page.

AI credits. AI analysis features consume credits. Credits are included with paid plans and can be purchased as top-ups. Unused credits do not roll over between billing periods unless otherwise stated.

Payment. By providing a payment method, you authorize us to charge all fees when due. All prices are in USD and exclusive of taxes unless stated. You are responsible for any applicable taxes.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds. We do not offer refunds for partial billing periods or unused credits except where required by law. If you believe a charge was made in error, contact us within 30 days at support@bionicforms.com.

6. AI Features

AI analysis features are powered by third-party large language model APIs (currently Anthropic's Claude). When you trigger AI analysis, the text content of selected form responses is sent to that provider to generate summaries, sentiment scores, themes, and urgency ratings.

Accuracy. AI-generated outputs are probabilistic and may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing AI outputs before relying on them for business decisions.

No training on your data. We do not use your form responses or AI analysis results to train our own models. Third-party API providers are contractually bound not to train on API inputs; however, you should review their respective usage policies.

Prohibited AI use. You may not use AI features to generate or assist in creating deceptive, harmful, or discriminatory content, or to process personal data in ways that violate applicable law.

7. Intellectual Property

Our IP. The Service, including its software, design, branding, and documentation, is owned by Bionic Forms and protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription.

Your IP. You retain all ownership rights to the form definitions, questions, and response data you create or collect through the Service. We claim no intellectual property rights over your content.

8. User Content

"User Content" means all form definitions, questions, response data, file uploads, and other content you store in the Service. By using the Service, you grant us a limited license to host, process, and display your User Content solely to provide the Service to you.

You represent and warrant that:

• You have all necessary rights to the User Content you provide
• Your User Content does not infringe any third-party intellectual property rights
• You have obtained any required consent from individuals whose data you collect through your forms
• Your use of the Service complies with all applicable privacy and data protection laws

As a form creator, you act as a data controller for the personal data collected through your forms. We act as a data processor on your behalf. You are responsible for providing appropriate privacy notices to your form respondents.

9. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Google (OAuth and Sheets), Meta (OAuth), Anthropic (AI analysis), and email delivery providers. Your use of these integrations is governed by the respective third party's terms of service and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services. Enabling an integration does not transfer your obligations under these Terms to that third party.

10. Termination

By you. You may close your account at any time by contacting us at support@bionicforms.com. Upon closure, your data will be deleted within 30 days.

By us. We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. We will attempt to provide notice where legally permissible.

Effect of termination. Upon termination, your license to use the Service ends. Sections covering intellectual property, disclaimers, liability limits, and governing law survive termination.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or completeness of any AI-generated content. Your use of the Service is at your sole risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIONIC FORMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and — for significant changes — sending an email to registered users. Continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.
